What Are Spill Prevention, Control, and Countermeasure Plans (SPCCS)?

Facilities with an aggregate above ground oil storage capacity greater than 1,320 gallons or a completely buried storage capacity greater than 42,000 gallons are subject to Spill Prevention, Control, and Countermeasure (SPCC) regulations, if there is a reasonable expectation of a discharge into navigable waters of the United States or adjoining shorelines. SPCC regulations define oil as, “oil of any kind or form, including but not limited to: petroleum, fuel oil, sludge, oil refuse, and oil mixed with wastes other than dredge spoil and oily mixtures.” Other forms of oil include non-petroleum oils, synthetic oils, animal fats, oils and grease, and vegetable oils. Oil Storage as defined in SPCC regulations includes all oil-storing containers equal to or greater than 55 gallons. If your facility meets these criteria, you are subject to SPCC regulations and are required to implement and maintain an SPCC Plan.

SPCC Plans are preventive measures to ensure oil spills are contained and countermeasures are established to prevent the release of oil into navigable waters. Preparation of an SPCC plan is the responsibility of the facility owner or operator. SPCC Plans may be prepared by a consultant or engineer, but must be certified by a registered Professional Engineer (P.E.) unless your facility stores less than 10,000 gallons (238 barrels) of oil. If your facility stores less than 10,000 gallons (238 barrels) of oil, you may qualify to self-certify your SPCC Plan.
